    Hi,

    I am a f2 dependent and my husband (f1 - currently in his Opt ) would be filing for his tax return .

    In order to claim exemption on dependent should we apply for a Itin separately or with the tax return ?

    Also, we got married in 2015 but I came to UNited States in Jna 2016. Thus, is my spouse eligible to claim on exemption for a dependent while filing the tax return for 2015

    Requesting a prompt help.

    P.S - the home country for both of us is INdia

    Yes. You can apply for ITIN number for your spouse. But not eligible for 2015 tax exemption because your spouse was not physically present in USA for year 2015.

      Hi,

      Thanks for the revert. However, in my earlier post I forgot to mention the below:

      1. I got married in 2015 in the United States under b1 status . My f2 was granted to me in nov ( in India) . I entered the United States on f2 in jan 2016 .... So still my spouse (on f1) is not eligible to claim on exemption on my dependency .

      2. Also my husband in 2015 would only file returns for himself and not me ? Right ? As I came to United States in 2016
