  • Green card for parent with handicap adult-child

    My wife (Naturalized US Citizen) would like to apply for a Green Card for her mother in Iran. We have a new baby and she offered to come live with us and help take care of the little guy.

    Applying for my mother-in-law should be straight forward (Parent of US Citizen), but my brother-in-law is handicap and my mother-in-law wont come to the States unless he can come too. He is over 21, has a mental disability, lives with my mother-in-law, and requires daily care.

    I believe my mother-in-law should be able to get a green card fairly quickly. I know we can apply for my brother-in-law's green card (sibling of US Citizen), but we are afraid it takes years for him to get his green card.

    Is there any provisions in which a both my mother-in-law and my brother-in-law can both get green cards at/about the same time? If not, would it be faster to apply for both now or have my mother-in-law apply for her son once she gets her green card?

    Guessing since it was written 5/2015 that it is still applicable. I guess the secon part of my question still stands "would it be faster to apply for both now or have my mother-in-law apply for her son once she gets her green card?"

    Basically how can I get both of them in the country the quickest?

    The immigration attorney website citation provided a good explanation for your specific concern (better than most such narratives from immigration lawyer websites).

    Your best option is to get mom here first, about a year, and then mom petitions her son, which will then take about 10 years.

    One additional option you may consider, which was not mentioned in the website citation, is to seek Congressional assistance to obtain a "humanitarian parole" for the handicapped child. Such parole approvals are often granted by the State Department on a discretionary basis as a courtesy to the particular Congressional office.
