    Hello,

    My name is Max and my Canadian wife and I started this process in October of last year. On November 16, 2015 our case was updated saying that we are ready to be scheduled for an interview. My wife already did her fingerprints and received her EAD card as well. We are located in New York, NY and I see that there is a logjam in the processing for cases I-485. The last known case was resolved on May 12, 2015. Which puts us about 5 months behind schedule. We thought that we would be hearing some news within the coming months does anybody know how accurate that information is or what time frame we should be hearing something? Would like to interact with similar people going through this scenario in New York.

    Secondly. My wife's mother is very sickly and we were looking to file a I-131 to allow us to travel to and from Canada so she can visit her during this process. Has anybody filled this form out and have had success or a time frame for it? Thank you so much in advance!

    Hi Max, the people that I know that have filed for AOS have all sent in the I-131 form as well, and have all gotten it approved. Just make sure you explain to them the reasons for travelling.

      It will now cost you $360 to submit the form. It is advisable to complete one of these forms within the AOS package.
      1) to avoid the additional fee
      2) you never know what event / opportunity might present itself meaning you are required to travel outside the country.

      It doesn't appear that many people have been rejected when applying for advance parole. I would suggest that you provide some proof of illness that requires a visit just to cover bases. Could be a letter from a doctor outlining health issues.


      She would have received this at the same time as her EAD. Hindsight is a wonderful thing, but the sooner you submit it the sooner you will get an answer. You will u doubtedly have a case reference or Aluen number so be sure to quote that to expedite proceedings.

      Best if luck abd hope your mother in law has a speedy recovery.

        Thank you so much for your response. Sorry I haven't answered earlier I thought I had my email set up to notify me when I received an update! I'm hoping that this will come sooner than the response for the interview. I'm going on now 5 months with the status stuck on "waiting to be scheduled for an interview".

          I may have led you astray slightly, check on the fact that as you have submitted and paid the fees for the I-485 you might be able to submit the I-131 if you attach your approval letter for the I-485. There might be some other action to take to get the fee waiver so check out the USCIS website as I believe you can still submit it for free.

          I'm far from being a person with knowledge on these matters as I'm starting the journey myself.

            I'm looking to file the paperwork this weekend. I see here to attach a lot of things like photos and stuff of that nature on the I131 Help form. the USCIS person on the phone just told me to fill the form, sign it, and attach the notice of action for the I485 since I already paid for that.

              Hi Mbravo sorry to hijack your threat, but I have very similar issue as you; also living in NYC and need to leave the country. I'm going to apply for parole this weekend. Did you say that you no longer need to pay the fee? $360

                That is correct. You do not need to pay the $360 for Advance Parole if you have already filed for I-485. I send the check with my I-131 and it was returned to me. I still received advanced parole for my mother.

                  Thank you! I didn't sent a payment. fyi, it did say on the website that we do not have to pay if we file i485.
