  • I-864 and I-693

    Hi all,

I'm a non-US citizen married to a US citizen (my husband). I'm applying for AOS and I'm almost done with the paperwork. I just have 2 questions left. if someone could offer me any clarifications, it would be greatly appreciated! Thank you!

    1) I-864 household size calculation: my husband's income does not meet the 125% poverty guideline requirement, so we're also including his father's income. Should my husband file the I-864, list me as the principal immigrant, then list his dad as another member of his household, for a total of 3 household members? We currently live in the same house. Under this scenario, my husband's mom and his brother will not be included as part of the household because we're not counting their income to help us meet the income requirement. Can someone please confirm this? Household of 3 and I-864A for my husband's father? Or do we have to list a household of 5 just to disclose everyone else that's part of the family?

    2) I-693: we'd like to file the application asap, and I was told it was ok to bring the I-693 to the interview. I'd rather not let the medical exam hold up the whole process because everything else is pretty much done. Can someone confirm that this is the case? Also, does anybody know how much time I'll have between submitting the papers and being called in for the interview? I just want to make sure I'll have enough time to schedule a medical exam within that timeframe.

    Thank you for your input!

Dad should complete an I-864A to be submitted with your husband's I-864. Dad will be counted as a household member on your husband's I-864.

If you don't submit the I-693 with your Adjustment package, your processing may be held up by an evidence request for the medical exam envelope.
