  • Problems with Medical Examination

    First time poster here.

I have been working hard for a few weeks now to fill in all of my paperwork to get it submitted before 03/31/16 which is when my non-immigrant visa runs out. I just found out that I need to submit medical examination documentation with form I-485 (and the rest of the forms) but I really don't think I'm going to be able to fit this in before 03/31/16.

What are my options here? Can I file everything and then send the medical examination documentation at a later date? I'm scared that if I don't send in my forms before 03/31/16 then I will be ineligible to adjust status.

if this is for Adjustment from a fiancee (K1) or other nonimmigrant visa, the Adjustment package can be sent after the allowable visa period has ended.

Don't count on sending the medical exam to USCIS afterwards, unsolicited. Either send it with your Adjustment package or wait unitl you have the medical exam results in a sealed envelope and send everything at the same time.

So if I waited until I get my medical results through and then send in the whole package you think I'll be all good? I thought I read somewhere that if my paperwork arrives after my visa expires then it makes me ineligible to adjust my status which is what had me worried. For informaion my visa is an O1.

I've never heard of an O1 visa.

Can you clarify what type of visa it is.

It's an extraordinary abilities work visa. I came over to coach rugby.

I believe these types of visas are usually reserved for individuals with extraordinary abilities in science, education, business or sports for an O1A visa and those with extraordinary abilities in the arts, film tv etc in the case of an O1B visa.

I don't think it is an issue for you to submit your package after the visa deadline has expired but worth you having other people contribute to this discussion. I would suggest completing your medical asap.
Usually only takes a couple of days to complete if everything is clear (TB test). If you have clear concise vaccination records it will also potentially mean lower costs too!
Factor in an approx cost of $400 depending on what is required and where in the country you have this done.
Reminder, it has to be from a civil surgeon who is approved to conduct such an examination.
