I485 timeline

  • I485 timeline

    I'm sure I would have to look deeper for this but I was wondering if anybody had a recent timeline for a complete I485 Process. I know they vary depending on where you're filed. I filed mine in NYC and my timeline looks like this.

    10/5/15 Filed paperwork
    10/9/15 Received NOA
    10/25/15 Biometrics Done
    11/16/15 Ready to be schedule for an interview
    12/23/15 Received EAD.

    USCIS website shows that the I485 processing time in NYC is delayed all the way back to May 12th but when I called my USCIS officer told me my paperwork is on time and still in the MSC phase. I was wondering if anybody could maybe give a little clearer of a timeline for the whole process or when I perhaps would be receiving the letter for interview?

    I filed on 22 December 2015 and till today haven't heard anything about my EAD I made two inquiries online and also spoke to a L2 officer on the phone who told me to wait that my case might be on an officer desk as he talk to me, I'm really beginning to get worried I live in Dallas Texas

        I-485 Timeline

        My wife's was filed in Chicago, IL. We are in the beginning process but here is our timeline so far.

        3/21/16 Sent I-485, I-130
        3/23/16 Delivered to Chicago, IL FedEx
        3/30/16 Checks Cashed
        3/30/16 Received email USCIS Acceptance Confirmation with Receipt#
        Waiting on more updates....Will update as we know.

        If anyone else has updates would like to see just so I know how the process goes! Thanks.

          I-485 Timeline

          I filed on the same date they received my package on march 23rd 2016 and our timeline is exact same, and I also filed in chicago can you please tell me that what is the starting 3 letter of your receipt number as it indicates the service center.

            My husband and I filed in Sept. Our PD was 9/29. He got his employment authorization in early December. My understanding is that this should come within 90 days of filing and it comes from the National Benefits Center. Then the case is transferred to a filed office depending on where you live, and different offices have different timelines. We are in Boston and we have his interview in mid April, so if all goes well it will be 7 months from filing to Green Card approval. I recommend poking around these forums and the trackers to find people near you and see what their timelines have been.

                  Hi. I also filed at Chicago office last February 8. Done my biometrics last March 7, 2016. Now we received a letter for RFE asking the petitioner for evidence of assets as my husband did not meet the 125% of the poverty guideline. Strange because he earns more than $100,000 a year since he is a nurse.
                  Can someone help me to find out the basis for this 125% poverty guidelines. Thank you

                        As you know the guidelines are here https://www.uscis.gov/sites/default/...orm/i-864p.pdf
                        I would check the copy of the I-864 you have submitted as you may have omitted something or entered data in the incorrect box.
                        If as you say the salary is as high as that and you have tax returns to verify it then there must be an error in your inputting.
                        Usually people will say that you must comply with the letter and provide the information. In your case verifying the salary again, latest pay Stubbs, employer letter etc should be enough followed by stating exactly what error you have made on the form.

                        The income is from a US source correct? Plus I doubt your household size prohibits you from meeting the guidelines, especially a salary so high.

                            The amount mentioned on the guidelines is the salary annually? right?

                            We have checked the forms that we have submitted and we only found one error in which it was mentioned on the letter that we received from USCIS.
                            They were asking us to rectify the page 4 of form I-864 because we forgot to answer the Part 5 question 1. And we have to put 2 on the question 8 as the total household size.
                            We also attached the copy of my husband's 2014 tax returns since he still has not filed his 2015 tax returns at the time of the submission of the I-130, I-485

                            When u say evidence of assets, we need to provide all of those or just a few?

                              Having checked the firm I still don't understand why you are required to submit proof of assets as this simply should not be required. If the income is from a U.S source (i.e. US company) your petitioner has more than enough income to cover it.
                              You are absolutely sure you have used the correct amount in Part 6 Q2 and Q15 Of the form on page 5?

                              As it is your spouse sponsoring he will need to demonstrate at least 3 times the difference between his annual salary and the poverty level guideline for your household of 2. So for example if your husband only earned 15,000 a year he would need to show assets of $15,075 as a minimum (difference of poverty guideline for household size minus salary ---> 20,025-15,000=5,025 x3) assuming he is not in the army and you reside in the contiguous 48 states.

                              Note for assets the following applies
                              "Only assets that can be converted into cash within one year and without considerable hardship or nancial loss to the owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis for the owner’s claim of its net cash value."

                              In your case with such a high annual salary thus just doesn't make any sense. I don't think you need to declare every asset you own by the way. There is a lot more on page 9 of the I-864p instruction guide that is well worth a read as it goes into detail regarding your real estate being used as an asset which is usually the most valuable one people own.
