  • Address change problem?

    Hi all,

    Fastly approaching the date where I can apply for my ten year green card. Currently collating all the information I need for the package.

    However, I have moved twice with my spouse during my two year conditional greencard period and haven't once informed USCIS about these changes of address. (Ignorance on my part). Is this a major issue? I have about 6 weeks until I can send off to remove conditions. Are there things I should do now to rectify this?

    I'd hate it if it were to jeopardize our future.

    Any help or experience in this area will be greatly appreciated.

    Should I just fill out an AR-11 for my new address (the same address that will be on the removal of conditions paperwork)

    What if some evidence shows our lease paperwork from another address that I haven't recorded with them?

      Complete the change of address form so that you are up to date. Although a requirement by every permanent resident, I don't think that will be a sound basis to be denied the extended GC. When the subject does come up then profusely apologise for the indiscretion and assure them that you will be up to date from then on.
      Concentrate on assuring them that for the last 2 years you have been law abiding, filed tax returns and can demonstrate a bona fide marriage still.

          From my understanding you both should be. The immigrant as well as the spouse who in most cases is the sponsor (US citizen) nominated on the I-864 form which does state that you must keep all addresses up to date too.

                  Only foreign applicant has to update address to be current. US citizens not required

                      From the USCIS website

                      "U.S. Citizens

                      U.S. citizens are not required to file a Form AR-11 and can make a change of address on pending cases via our Online Change of Address page or by calling 1-800-375-5283. For TTY (deaf or hard of hearing) call: 1-800-767-1833.
                      U.S. Citizens who do not have an application or petition pending with USCIS are only legally required to notify USCIS of a change of address if they have previously submitted a Form I-864 on behalf of someone who has become a permanent resident. If you have previously submitted a Form I-864 for someone who immigrated to the U.S., you must complete a Form I-865 within thirty days of the completion of your move."

                      As I stated before the US citizen has some responsibilities in informing USCIS if address changes pertaining to any connection with an I-864 form so be sure before you decide to do nothing.
                      In your case you're not a permanent resident yet so only you will need to ensure the AR-11 is completed and not your US citizen spouse. This is for future reference once you have successfully completed the process and are in possession of a GC you will need to ensure addresses are updated for both of you if you do move again.

                        Bare in mind there is no option for a US Citizen to do so on the online ar-11 form.

                          Having read your initial message it's clear you are a permanent resident albeit under the 2 year temporary GC. others are saying your spouse does not need to complete an address change. This is incorrect.

                          Answer the following... Are you a GC holder? Did your spouse complete an I-864 form for you during your application?

                          If yes then he does need to contact USCIS about an address change.
                          The confusion maybe attempting to do this in the AR-11 form. You as the GC holder completes that. He as your sponsor should contact them using the telephone number provided in the instructions they have online (I sent you an excerpt in the previous message which has the telephone number to contact them on).

                          I think it's relatively simple to notify such address changes so don't worry too much about it. You are trying to rectify it before your interview so I'm sure you will have peace of mind by then.
