  • I-485 for mother, I-864 and I-864a question

    Hi,
    gonna keep it simple.
    Im applying for my mother (Currently in the USA as visitor with visa) and need to complete I-864 (Affidavit of Support) with my info, since Im a student, do not meet the minimun requirement, so my uncle (who's a full time certified pharmacist) is going to file as a Joint Sponsor. From what I read, my uncle and I both must file each a I-864 for my mother; however, i am not clear whether he should file the I-864A form (Contract Between Sponsor and Household Member) or not. Please any advice on this would be appreciated! Thanks

    TL/DR: Applying for mom, uncle joint-sponsoring, does he need to complete I-864A or not?

    Your Uncle needs to file I-864 and tick 1d as the only Joint sponsor and you also need to file another I-864 for yourself as a the petitioner. Just best sure you include all most recent tax documents(form 1040), W2 and paytubs. I assumed you are not be claimed as a dependant by your uncle.

      Thanks alot for your reply! No, he did/does not claim me as dependent. So in other words, there is no need for him to fill oout an I-864A then? Out of curiosity when would I need to submit an I-864A? Thanks again

        yes, there is no need for your uncle to file I-86A but he needs to file I-864.

        If you are not the petition but a household member to the petination or If you are the intending immigrant and the sponsor is including your income on Form I-864 to meet the eligibility requirements, you need to complete this contract only if you have accompanying dependents.
        A household member completes this contract if the household member’s income and/or assets will be used to demonstrate the sponsor’s ability to meet the income requirements and to maintain the sponsored immigrant at an annual income at the level.
