Pls, Advice Before I Screw Up!!! F1 was out of status 03/2016, Married a USC 04/2016

  • Pls, Advice Before I Screw Up!!! F1 was out of status 03/2016, Married a USC 04/2016

    I was divorced last year with proofs and met my wife shortly. She was divorced in 2009. I was on F1 for over one year and lost my status a month ago. We got married on 04/2016 and had a beautiful wedding. I have questions on my mind because I have been out of status for a month else the filing processes are pretty comprehensible. Please, I need your advice so as not to screw up. My questions are:

    1. Can I file for AOS and I-130 concurrently ( out of status with a valid visa)?

    2. Do I need a lawyer?

    3. Do I need to wait for about a month after our marriage before filing since I am out of status? Although, my F1 visa still valids till 01/2017

    I am posting this before my application so as not to make any mistake and have a prior knowledge about certain information that may be shadowy in the application process. Please, help me out!!! Thanks a bunch fellas.

    Yes you can apply concurrently since you are the spouse of a us citizen you don't need to worry about been out off status people go out of status all the time

      Yes you can file cocurrently since you are married to a US Citizen.
      The file Process requires a lot of care and knowledge of the exact documents to file your applications with, If you think you can follow the instructions carefully you might not need a lawyer. If you have any criminal record it is adviceable you get a lawyer.
      It is always good you have proof of cohabiting together before you file (examples: intermingling of finance and payment of bills together).
