  • Spouse GC travel and impact on EAD

    Hi,

We have applied for GC process and I 485 is under process. Applied under EB1C category in Oct 2015. My wife has a L2 visa based on which we had obtained an EAD. She also has an approved AP (I 131). Following are my questions. Please advice.

    1. If she travels to India for 6 weeks and enters back using the AP, will the EAD be cancelled and has to be re applied ?
    2. If she enters back using the L2 visa (which is valid until Dec 2016), will it impact 485 process in any way?

Any similar prior experience or advice will help.

Hi, my situation was slightly different, but I hope this helps. I filed for i-485 last April, and got the AP/EAD card in June 2015. At that time my F1/OPT visa already expired. I travelled back home to China for 5 weeks in September and reentered the US in November with the AP/EAD card. In my experience, the custom officer only looked at the first page of the passport for your ID, and the AP/EAD for your re-entry. So it shouldn't matter.
