  • I-485 filing & Employer Portablity

    hi all:
I have an approved I-140 under EB-3 and I understand that my I-485 cannot be filed until the Priority date is current.

Lets say the priority date becomes current in May 06' and I immediately file I-485 , then in 180 days ( say by Dec 06') - THEN will I be I eligible for changing my Employer.

Getting my EAD or GC is not my immediate concern. With the retrogression stuff, I understand that EAD/ GC will take some time.

But 6 months after filing of I-485, am I eligible for moving on to a new employer..?

Would appreciate advice from folks who are more aware of current laws with INS etc.
    thanks in advance,
    Adit

you can change employer after your 485 case has been pending more than 180 days, but you need to be in the same or similar position based on your previous approved LC and your new employer has to offer same or higher wage than the one states on your LC. EAD is different story, you can file your 485 with your EAD together, and processing of EAD normally takes about 90 days only.
