  • I-485 Request for Initial Evidence Question

    My wife and I submitted our Adjustment of Status Package back on March 20th, 2016. Everything was going smooth we just did the biometrics appointment here in Salt Lake City last week. Today in the mail we received a yellow letter titled " Request for Initial Evidence". It says that the officer cannot complete the processing until we send this. It says to submit one of the following.... Evidence of your lawful admission or parole into the United States. It says such evidence includes but is not limited to the following.
    1. Form 1-94
    2. Arrival/Departure Record
    3. Form I-512 with completed arrival stamp
    4. Or a copy of the nonimmigrant visa page of your passport showing admission to the United States.

    The reason we are confused is that we sent a copy of her latest I-94 when she entered into the United Sates. Has anyone else seen this before or had this experience? Its frustrating because we don't want to send her same I-94 again and have them not accept it.

    It's not uncommon for requests to be made in evidence you have already submitted. Just be sure to send the evidence again as requested even if you know for sure you sent it in already. Do you have a photocopy of an actual paper copy (crossed by land at any time?). Visit the DHS website and print out the online version too https://i94.cbp.dhs.gov/I94/consent....qQV!1768450103

    Be sure the date matches what you have inputted in the forms. If they don't match then provide an explanation as to why they don't.
    Don't worry too much, officers can make mistakes in sending out an RFE that may not have been needed.

        Send Visa stamp copy,arrival date airport stamp in your passport,I-94 again

        I think what they are asking is not only I-94 but every possible document that can show how she entered to US.I entered as Visitor too and now filed for AOS on April 4th as I also got married to USC but I Submitted following documents.Give a look on following document and I think you should send whatever you have from these document if applying to your wife
        (1)old passport copy with visa as my B1-b2 visa was on my old passport
        (2)new passport copy
        (3)copy of an I-94
        (4)copy of a page where IO put the stamp of arriving with visa type and entry date and exit date(this is what they are asking in your case)
        (5)new I-94 (my case I changed my status from visitor to student visa )
        (6)school record I-20
        (7)copy of DL if issued any

        If your wife was on visitor visa than ignore document number 5-6-7 and if she has only one passport than ignore number 1 as well.But make sure you send number 4 with I-94
