  • 485 RFE question help --- Urgent

    I turned in my I-485 last year and forgot to answer the part three "Membership and Organization". I just received the RFE letter from the USCIS that pointed out that I didn't answer part three, but didn't provide instruction whether I should fill out the entire I-485 form again, or just supplement a page for the missing part? If I fill out the entire form again, will it be deemed as a new I-485 application?

    In the last year, I have changed my job and city, so the information on the previously submitted I-485 has changed. But I have already updated the address with USCIS.

    Please kindly advise the correct procedure I should do. Thank you all so much for your help!

    Add and amend the information accordingly on the I-485 (be sure you are using the latest one) and submit an additional page outlining the changes you have made and the reasons why (new job, new address etc). Don't forget you can add your Alien No now too.
    It's not a new application. It is important to also send the RFE letter that was sent to you as USVIS will then know why abd what you are responding to in terms of sending a new package in. This dies not mean you send in all the previous evidence documents submitted.
    Don't forget to sign it too!

      Thanks a lot for your suggestion!! To be more clear, should I fill out the entire I-485 with updated information (job, address, etc) and attach an additional page outlining the changes? What does the term "add and amend" mean? Sorry for the extra question, really appreciate your advice!
      I submitted my last I-485 last year and it already include the A-number.

        Yes, what I meant is complete the whole of the I-485 form again. Hopefully you have all the information from your previous form. If it's the same numbered version then edit the form and resubmit.
        All I meant was add the information that was missing previously and amend the details in relation to your new job and your updated address.

          Thank you so much for your explanation! So basically I need to fill out the entire form with updat-to-date information, and then resubmit. So this will not be deemed as a new application, but amendment to the existing application. Right?

            Yes complete it again.
            This is NOT a new application don't worry. You MUST make sure you send the RFE letter with it. As I said before its best to send a letter with it explaining the changes you have made, because if the RFE you have taken the opportunity to update the form.

            For your I-864 tax submissions, the income related to the latest tax return is all from your old job right? If so you wouldn't need to touch the information on that. However you may be asked to prove your current income and employment status later down the line such as at the interview stage so collect that evidence (pay stubs, letter from company confirming employment etc)

              You must submit all requested evidence at the same time. If you submit only some of the requested evidence, USCIS will consider your response a request for a decision on the record. 8 CFR 103.2(b)(ll).

              DID NOT ANSWER PART 3
              You submitted an Application to Register Permanent Residence or Adjust Status (Form I-485) on May 11, 2015. However, Form I-485 does not contain your answers to all of the questions asked of you on Part 3. Therefore, please answer Part 3-C if you have any present or past membership in, or affiliation
              with, any political organization, association, fund, foundation, party, club, society or similar group in the United States or in other places since your 16th birthday. Include any military service. If none, please so indicate. Also, please indicate if you have any foreign military service, and indicate for which country you served. Please indicate all dates and places of service, all ranks and positions you held and all duties you performed. If none, please so indicate.

              In the meantime, I saw another person with similar issue, but get the following response:
              RFE:
              1. You did not properly complete Part 3, Section C of your Form I-485 application. Therefore, submit an affidavit listing your present and past membership in, or affiliation with, every political organization, association, fund, foundation, party, club, society, or similar group in the United States or any other place since your 16th birthday. Include the name, location and purpose of each organization and your dates of membership. Your affidavit should also include any foreign military service. If none, then state "none" in your affidavit.

              The instruction for this person is very clear, to provide an affidavit; however, no clear instruction for me as to whether submit an affidavit or the updated form.

              Is it possible that I can simply send in a separate affidavit to answer the Part 3-C, and sign it?

                I wouldn't bother with what other people received in three RFE. concentrate on what you have been sent.
                If you don't think it's clear enough what they are asking then give USCUS a call abd request to speak with a tier 2 representative who will have experience as an immigration officer who might be clearer in eat they need as in your defence they haven't been explicit in how to respond to them.

                It's a serious letter they sent as they have quoted you their regulation [8 CFR 103.2(b)(11)] which basically says if you only send a partial response and not the detail they want then they will adjudicate your case based upon the information they have in their possession to date in your application. That could go either way then! Seems like only a minor thing missed on the application but they might have in their minds you have left the section blank because you don't want them to know you are or have been affiliated to a group that they "disapprove" of. Rather than what probably is the case in that you were just absent minded and missed out the section!

                Be clear which organisation/s you have joined. Talk to the officials if you have doubts ok.

                  Thank you so much dear friend! If I call them, can they pull up my record and see what exact letter I got? They need to see the details of the letter to see exactly what I need to respond, whether to attach an affidavit or resubmit the form. Or do I need to schedule an appointment with the local USCIS office to get clarified information, so they know at least I consulted with the office before responding.

                  I should have entered none in the organization table, it stated very clearly to enter none if so, but I was careless not to read it. I only joined an academic organization and there is absolutely nothing to hide. I heard there are quite some people making this error because of lack of experience.

                  Regarding an affidavit, where I can find a general format or template for affidavit for supplemental information?

                    They will have your records to hand I would have thought. Explain the situation abd gist you are u sure if the whole firm should be submitted again.
                    An affidavit is just a statement from you clarifying what you are saying. Such a shame that its a small error that is now holding you up!
                    In your statement you could add the petitioners name (spouse), the beneficiary (you) at the beginning as well as official references such as the case number and Alien number which you will also have. That will leave them in no doubt as to which case you are replying to!

                    I think a phone call will be sufficient rather than in person as your RFE is such a minor point to clear up. Alas they do say that every part needs to be completed, a lesson to all others completing their forms currently!
