  • Immigration court cases moved to 2019

the immigration court overload and lack of resources has caused to move many hearings to 2019 - anyone in this situation? What is the legal community advising their customers on this matter and are there any alternatives to this long waiting time?

      Hi,

I was in the same situation. I was suppose to have my court hearing last January 2015 but then I got the notification that it would be until 2019. Long story short, after some investigating, I told my Lawyer if they could do a Motion to Terminate petition. With this "Motion to Terminate" what the lawyer does is, writes to Immigration so that they could close your case through the Administrative side, rather then you having to wait till 2019. From there you can move on with your applications. I went to the lawyers on February 12, 2016 and by March 30, 2016 we received a reply back and they did close my case through the Administrative side. I went and applied for my Green card but now am just waiting on notification that they have received my package. However, my sisters lawyer did a Motion to Terminate petition for her in the beginning of April, but she still hasn't received any form of feedback from Immigration.

I hope you find this information helpful.

      Best wishes. - BR

Thank you for sharing your experience! Was the court hearing date schedule for the judge to issue a decision? Did the judge already hear the case? Or was this just the first hearing?

          Hi Hope123,

This was going to be my first hearing. I've read that you can use the "Motion to Terminate" to close various scenarios through the administrative side of immigration so that you can move on with your AOS or what not.
