  • Got married and submitted i-485/i-130 combo

    guys, i wanted to run this by you and find out rough timeline to get a better understanding.

    Please see the the timeline of process so far:

    I got married Dec 2 2015 [my wife was on B-2 tourist visa]
    We submitted i-485/i-130 [case number starts with MSC] on ~ Dec 16 2015
    Fingerprint request came for i-485 mid January 2016 [was completed]
    I-485 was updated on Feb 3 2016 to [Case Is Ready To Be Scheduled For An Interview]
    I-130 has no updates except the receipt notice

    It has been a while since the last update. We are located in NY.

    I am kind of anxious when the next update will come in and when we should expect to get the interview date or the green card:

    EAP [i-765 - pending] and AP[i-131 - received it already ]was submitted alongside [was submitted separately].

    Could you please clarify this for me?

    Hello,
    The estimate for NY is 8 to 9 month from your notice date. Moreover the EAD is pending cause its usually a combo from the I-485 form. Its part of the requirement for that form. But it is a choice if you want to apply for work ir not. They might had been reviewing it but ur I-485 was filed separately.

      In my case, the EAD (did not ask for AP) arrived 3 months after submission of I485/I130 combo. The letter schedulling us for the AOS interview came 8 months after submission.
      During that time I checked on the USCIS case status website weekly, just in case. It was frustrating to see the same answer for over 8 months, but it finally informed accurately that the EAD and the interview schedule were on the mail.
      Just be patient. It moves slowly but it does move.
