Concurrent Filing? i-130, i-485, i-785, G-325, i-864? WHAT?!

    Hello All!

    I am an American citizen that recently married my longtime boyfriend of 6 years. He came to the US on a B-2 visa in 2007 and never went back to Poland so he overstayed his visa. We got married in city hall last month and I want to start the process of sponsorship. From what I learned through extensive research on this awesome world wide web, here are the docs that we should submit:

    I-130
    I-485
    I-765
    I-864
    G-325

    My question is, will it be okay for us to file these forms concurrently? I don't want to waste any time, I want my husband to finally be able to get a license and for us to finally be able to go on vacation together. I'm sure everyone here feels my pain! I don't want to hire a lawyer as I feel I'm savvy enough to do this myself. If it matters, I'm 28, he's 31 and we're both Polish.

    Yes most people file concurrently.
    you will need:
    I-130
    I-485
    I-765
    I-864
    G-325 x 2 (one for you and one for your spouse)
    if your income do not meet the requirement, make sure you get a sponsor to fill out another I-864. if the sponsor lives with you then he/she will have to fill out I-864 A.

    proof of bonafide marriage include:


    1.Wedding card or marriage certificate
    2.Joint bank account
    3.Joint credit card statement=
    Copies of actual credit card,health insurance with same account.
    4.Joint club membership
    5.joint federal and state tax retrun
    6.photogragh taken before and after marriage that include parents and relative from both families.
    7..copies of letter or email bew teen you.
    8.phone bills shoewing your conversation
    9.auto registration showing joint ownership.
    10 . rental agreement, lease agreement
    11.receipt of gifts (such as flower,jewelry,art,candy etc)
    12. Hotel and airlines receipts shoeing trips that you have taken together.
    13.utility bills
    14.evidence of life insurance with other spouse.
    15.car,health or life insurance* policy both of your name. .
    16.copies of Christmas cars or other holiday card addressed to you both
    17. Other family pictures of you both.
    17. Driving license same address together.

    Also if his birth certificate is not in english make sure you translate it to avoid an RFE

      Another very important thing would be your timeline.

        Might as well include the I-131 for AP travel purposes, although refrain from using it unless necessary. The I-765 will allow him to apply for SS# and seek work and then he can get a drivers license/ID as well.. If you file the I-131 with the I-765 they provide you with a combo card rather then a peice of paper which I find more fruitful. As everyone mentioned the I485, I130, I765, I131, I864 and G325 are the concurrent forms to file. I would make sure you translate any documents your husband has in Polish to English as they will want those and they have to be a certified translation. Definitely file these forms concurrently and provide all of the necessary photos and documents along with them. The more you provide the less of the delay you will have during the waiting process.

        Oh and forgot to mention your husband will need to see a civil surgeon and have document I 693 completed and placed into a sealed envelope. You can send this with the concurrent filing or wait to bring it to your interview.

        01/07/2016 - Interview Chicago Field Office
        03/27/2018 - Notice of Intent to Deny
        04/13/2018 - Submitted Rebuttal to NOID
        06/00/2018 - Received Approved I-130
        06/00/2018 - RFE received for updated Medical Exam
        06/12/2018 - Submitted updated Medical Exam
        07/02/2018 - Received Approval for I485
        07/06/2018 - Received Green Card in Mail

            Apply ALL the forms all together.
            I suggest the following:
            1. print latest form of each
            2. print instructions of each forms ( read it thoroughly)
            3. Make sure every forms has its separate supporting documents. It will require same documents one of the other.
            4. All documents support photocopy.
            5. include cover letter.
            6. the more supporting bonafide real is your marriage is the better. No need to send pictures this will be reviewed in the interview. Letter from your family and his side, utility bills, leases, taxes you submit must be at least 3 years covered even if they are just asking for the latest, including w2 (3 years) this will help them review better the beneficiary affidavit support.

            We did the same no Lawyer, as long as your keen to details and right information form,nothing to worry.
