  • I864 income - do we need another sponsor?

    Hi,

    I am helping my friends to apply for green card. The husband is an american citizen and the wife is from Italy.
    in 2015 he made $34096, between 3 jobs, but 2 of them he is not working anymore. As of today he is in one job and the annual income
    is $18,631.

    From my experience with adjustment of status, I think they are good. 1) because he made 34k last year 2) the current income is pretty close to the 20k needed and 3) 2016 is still going on and both of them can get another source of income.

    They wanted to put 34096 as the income right below his current occupation. I said it is wrong, because they are asking for current employment and current income and he no longer have the other 2 jobs. The total in the next part should be 34096, but we don't have space in that page to explain that, so I said they could write in the last page (for additional information) explaining that although his current income is 18631, he made 34096 last year.

    This is the only issue they are having with the process, everything else is alright, so I said that maybe it would be better to ask here, from my process to many other people I have helped, I always got nice people to give an opinion!

    Hello,

    You are right, they have to indicate whatever is the current income of the petitioner. As far as I know it is indicated in the form from current to last 2 years income will be declared. Any additional explanation you can add extra sheet behind form.

    NOTE: ensure the petitioner will meet the range 2016 HHS Poverty Guidelines for the Affidavit of support.

      But considering the current 18631, but 34k last year, do you think they need a sponsor?
