  • USCIS Lies.....i Need Help PLEASE.

    uscis is lying about my application.

    Am married to a us naturalized citizen.
    We got married Aug,18 2014.
    This is my timeline.
    June,13 2015....Filed AOS i-485
    June 26 2015....recieved receipt
    Fast forward, I went for fingerprint and eventually recieved my EAD.
    Dec,26 2015 .....We scheduled your interview for Jan,27 2016.
    Now on 27th January my wife and I went for the interview.
    On arriving in the io office he said "this is going to be real quick" we don't need to go through your document because your marriage is not "Valid" I asked him why is it not valid cos we got married here in US. He said he is going to send it on writing .the officer was so mean to us he nearly forgot to swear us in, he bear barely look at us, even telling us there is no way for us cos even if we recieved the letter he doesn't think we can prove that the marriage is valid.

    So my wife and I reported him to the supervisor in writing cos guys the officer was so mean as if we were not human , after two weeks still no update. We schedule an infoPass and we spoke to a very nice humble IO who told us to put our experience in writing cos he believes the first letter was not delivered. He then said we should expect a response in a month but still three months afterwards no response kept calling they keep telling me my application is pending consideration. I spoke to an IO on phone who said the application is pending. We decided to involve the senator in this case as is almost one year and No GreenCard, no update. And last week Friday they emailed me saying .......On JANUARY 26, 2016, we have mailed your Request for Evidence on Form I-797, Notice of Action, Form I-72, Request for Evidence, or Form N-14, Request for Information and/or Documents, to the most recent address we have on file. To date, we have not received a response.

    What You Can Do
    * Ensure that we have your current mailing address;
    * Verify that you are registered to receive mail at the address you provided to us;
    * Follow any instructions on the notice;
    * Respond to the notice by the response deadline; and
    * Submit any requested information and the original notice with your response.

    Important Information
    We encourage you to respond to the notice by the response deadline. Regulations do not provide for an extension of time to respond to our notice.

    If you do not respond to our notice by the response deadline, we will deny your petition/application due to abandonment.

    You may not appeal a denial due to abandonment; however, you may re-file your petition or application at your earliest convenience.

    And this is all lies they never sent anything, how come they trying to accuse me for not responding to the RFE after I involved the senator.
    How come the IO we spoke to on the phone not tell us they waiting foe my RFE.
    How come when we went to the infoPass the IO didn't see they've sent me an RFE.
    How come whenever I call the USCIS rep. tells me application is pending so I should wait. Guys we really need help as we've scheduled an infoPass on June,10.

      She's been here for 7 years now so autimatically she qualified for citizenship. She came here through the DV Lottery.

              Africa is a continent not a country. I don't think you automatically get citizenship until u waited the allocated time period, applied, and approved. so, uscis said the marriage is invalid? did you guys marry at a court house?

              i don't really understand ur complaint? not because you applied for a green card that don't mean u r automatically going to get it. you getting angry will just irate them. just go find out what the RFE are and mail it them asap

                yes we did get married in court house and we have the marriage cert

                she is from South Africa


                yes i do understand that not becos i applied for a GC mean am going to get it, but my complain was since 27th January 2016 we went for the interview We didnt hear anything from them after numerous attempt to get the reponse they always say "Pending"then they emailed me saying theyve sent me rfe on Jan,26 and that they waiting for response which is lies cos i didnt get any rfe. moreover i believe if they sent it then the time to respond is already past. am confused guys . any suggestions

                  ok, it must be trackable, go to local post office, when you go to meet uscis ask them when the mail was sent and tracking number.

                    Iuy87: I even did call uscis to ask them for the tracking number so I can't go to the post office to see if it there but the rep.told me he can't see on the system anything of such and that there was no RFE sent. Then he transfered me to an immigration officer who also didn't see anything. So confused
