This is my first post here and wondering if there are some of you who is in the same situation as me.
My main question is? Do I need to include Form I-797 Notice of Approval to the package that I will be sending for applying for Adujstment of Status?
Here's my history:
My father (Naturalized US citizen) applied for US petition under 21 in 2014 (IR-1) (I was 20 years old back then) so my visa number is already available for consular processing,
I-797 was received stating that the petition is approved.
My father had financial issues in 2014 so he wasn't able to continue to submit affidavit of support.
I came to the US in 2014 via B1/B2 Tourist visa and before 6 months I left to go back home. (didn't overstay)
In May 2016 I came back to the US via B1/B2 Tourist visa and now staying at my stepfather's house in Houston, TX. (My biological father is in Chicago)
My father spoke to me and told me that his financial issue is resolved and we can apply for adjustment of status whilst I'm here so we don't have to go through consular processing, here I am researching for documents needed.
It shows in one of the articles of this website that the I-797 Notice of approval is required and is attached to the package sent together if for I-485.
It also shows that both the petitioner and the applicant will receive I-797 Notice of Approval one copy each. (One sent to US citizen in the US, and one sent to the foreign address)
UNFORTUNATELY, I did not receive my copy of I-797, and my father lost his copy too.
It also shows in the website that we can obtain a copy of I-797 with a fee of around $400.
I don't want to pay that amount of money just to get another copy of that piece of paper as this has to be in their records already.
I just want to ask if I-797 is required for adjustment of status?
Has anyone applied for AOS without having to include their I-797?
