  • OPT - 90 day unemployment to I-485

    Hi,

I have a question on my current situation. When i'm on OPT, I have gotten a volunteer through a professor which allows me to stay in status. (unemployment >90 days) That is a couple of years ago and now, I'm applying for I-485 and wonder if this will cause a problem since i have lost the letter. Since the professor signs the letter, the school would not have a copy. Does USCIS keep a copy of it since i submitted to them ?
I'm wondering what will happen if I entered into the application and they request for an RFE and I couldn't provide it. It's been 4 years and i'm only there for 3 months which i think the professor might not even remember me. I'm wonder will that be consider out of status if i cannot provide the proof (if the professor don't remember and would not sign it again)?

2nd question. For example, EAD start date Aug 2nd 2012 and i got the volunteer on October 2012 till Jan 2013 and i got a job offer on Jan 7th 2013. That would be fine.
If i enter into my application with EAD start date Aug 2nd 2012 and i got a job offer on Jan 7th 2013. That would be a violation for over 90 days unemployment. Does the Out of status continue to accumulate after Jan 7th 2013 ? I have got my OPT extension and H1-B approved after that (over this couple of years) and now since i'm filling for AOS, will it affect it ?

I have also leave and re-enter US multiple times to visit family on (2013 (OPT extension visa) - 2014 to 2016 (H1-B visa)). I heard that since my last lawful entry is in 2016, the previous violation will not be counted ?

I'm trying to figure out which is the best way to file my I-485.
Please advise... Thank You very very much.

u r ok! if that was a problem u would get opt extension and h1b approve. u should be fine, they will request copy of opt card and h1b visa

I always over think to much when it comes to visa application. Thanks for getting me back in line. It might also be because my company seems like they have no idea what they are doing/applying.
