My (UK passport holder) husband left the U.S while his I-485 was still pending without getting an advance parole document because his mother was sick.
He did not have any K, H, or other visa foil in his passport, as he came in under visa waiver (long story but we were living apart and he did not intend to stay at the time of his visit).
We have the I-797 for his I-485, I-130 (to prove he was in legal status).
His EAD came in the mail today (which I am sad today is clearly marked NOT VALID FOR REENTRY TO U.S. because it didn't even occur to us to file an I-131 at the same time that we filed for the EAD)
If he gets on a flight, is there a chance they will just parole him back in?
If not, what is our next step? File an I-131? Go to the U.S. consulate or embassy and seek some sort of visa or parole document?
Are we basically starting from scratch?
