  • I need an explanation. Anybody?

    Hi everybody

    I really try to find some answers on my case.
    I applied form I-485 as a non-Cuban unmarried child of a Cuban citizen

    I sent my package to USCIS on March 1st

    they sent me a notices on my form I-485 and I-765 on March 8th

    Did successfully my biometrics on April 5th

    Since then no answers where I was waiting those 90 days for my EAD card. I called USCIS on June 2nd about my I 765 case and they put a service request.

    After that they sent me an RFE which I got in mail today June 17th saying that I need to submit a principal Cuban citizenship documents ( Cuban birth certificate, consular birth certificate, Cuban passport)

    I'm really confused, because I'm not and never been a Cuban citizen and I even filled that in I-485 form. It can be an error from a USCIS office or what? I even prevented any problems and sent in my package my Cuban father's green card and his Cuban passport.

    I'm really on the verge of, like a mental breakdown I got an amazing job offer and really need that EAD ASAP. I don't know why but I think they messed up my process. Can I request for a expedite request of my EAD??

    Anybody with some answers or help. Thank you guys

      Not true USCIS.gov says this for family based Cuban natives;

      Family Member of Cuban Native or Citizen Applying Under the CAA

      The spouse and child(ren) of an individual applying for a green card under the CAA may also apply for benefits under the CAA regardless of their country of citizenship or place of birth, if:

      The relationship continues to exist until the dependent spouse or child receives a green card

      They are residing with the individual applying for a green card under the CAA in the United States

      They apply for a green card under the Cuban Adjustment Act

      They are eligible to receive an immigrant visa

      They are otherwise admissible to the United States for such permanent residence.
