  • I-130 Approved, I-485 still pending. 6 months later

Help! Has anyone else had this kind of experience?

My husband and I filed our I-130 and I-485 back in August of 2015. Everything in the process was going very smoothly. We had our interview in January of 2016, which went very well. At the end of the interview, the officer congratulated us and told us that within a few weeks we should get our approval and get my husbands passport stamped until his green card came in the mail. She said that the status of our I-485 should change to show we had the interview.

The next day our I-130 was approved. However, the I-485 status never changed! It has been six months! I have submitted several inquires and all I receive is that our case is pending "adjudication". I made an info pass at the local office and all they could tell me is that the case is still with the officer. They let me hand write the officer a letter, in which I explained everything and asked for an update. I still did not receive anything. I don't know what else to do. Is this normal? Should the I-130 and I-485 been approved at the same time? What can I do to have someone look into it?

Any advice would be great!! Thanks in advance!

I have a very similar timeline, my wifes application was submitted on August 2015 and the interview was assigned for January 7th 2016. The officer basically said she was going to approve and work on it the same day, however we are still waiting for an update. Our online status shows that our interview was scheduled, but has not been updated since being assigned back in December. We are going to be approaching 1 year since we filed the application in August. This is getting to be anxiety ridden. We filed in Chicago. Im not sure what else to do at this point except to continue to wait. I have made several inquiries online to request status but to only not hear anything back.

What should I tell the congressional person? I have a similar case. We had our I-130 interview in TX on 2/29/16 and it got approved. The case was then transferred to new a jurisdiction since we moved. Four months later, I-485 is still pending and no updates.

Same here, Interview date 30th March
31th March I-130 approved and still waiting on I-485.
Officer made favorable recommendation on my case but when i went to local office they have said that my background check has not been completed which does not make sense i do not even have any traffic tix.
nothing else to do but waiting.
          good luck

I-130's get approved relatively quickly because they are not really asking for anything, they are more declarations that you intend to support someone who is asking for immigration status. Therefore, I-130's tend to get approved quickly. I-485's are the actual meat and potatoes of the immigration process. In the past, 6 months was more or less the average wait times. There have been extreme influxes of certain kinds of immigration petitions due to various global factors, but this basically just means there is too much work and not enough USCIS agents to do it all. So we are now seeing an increase in average wait time from 6 months to 10-12.

Thank you for answering, so whenever i call customer service they are telling me that the local office working on the case from Nov and my PD is Dec so that means most likely i will have to wait till they start issue Dec files? So confusing
