  • Abandoning Adjustment of Status

    Hi,

    I am Norwegian and married to my American wife, but we are in a bit of a bind, namely her not making enough to be the sole sponsor and no one willing to become a joint sponsor, so we have concluded with me returning to Norway to start working and thus abandoning the whole Adjustment of Status. So, my question are these:

    How does one formally abandon the adjust of status process?
    If I leave the US now, can I come back as a visitor on a Visa Waiver Program or am I banned from re-entry?

    Hopefully someone have gone through something similar and can share their experiences.

    Failure to show up for the Adjustment interview or to respond to a "Request for Evidence" is either automatic abandonment or automatic denial. In either case, you can reapply for Adjustment of Status in the future with an entirely fresh I-130 (if that approval hasn't expired) and new I-485 with new medical exam.
