AOS denied! Help!!!

  • AOS denied! Help!!!

    Hi!
    Got a message yesterday that my I-485 was denied. I have no idea the reason because I am out of US with my husband (vacation). I still in shock and was not able to tell him yet. We have my combo of EAD and AP. Does CBP knows the update of USCIS?
    If I can't get in the country, can my husband apply for k3 visa?
    Btw, my husband is American and I enter with him on August 15, 2015 as K1 holder. We got married on September 4, 2015.

    I truly appreciate any help and advice.

    did u attend the interview? if not they [probably denied u because u missed the interview appointment...or missed some letter they sent you. damn how long was ur vacation?

      Iuy is right that a missed interview would have resulted in a denial, but also a failure to respond to a "Request for Evidence" would have caused a denial.

      You can still file a "Motion to Reopen" if you are within the 30-day denial period and if you have clear proof that the denial was in error.

      Forget about a K3, as they aren't supported by USCIS anymore. You will be applying for a CR-1. But if you are allowed back into the U.S., you can submit the I-130 and another Adjustment of Status concurrently.

          I'm sorry to hear about your denial but the priority should be Green Card ... not vacation!

          Anyways there could be many reasons behind the denial until we know the details of your case.

          Did you even inform USCIS that you wont be able to attend the interview and rescheduled the interview?

            She probably had an Advance Parole, which would have allowed her to reenter the U.S.
