Hi All,
My priority dates are current at this moment and my Employer/Attorney going to file my I-140 and I-485 concurrently (we are going to file my Spouse's I-485 application also with my application)
Few days back my attorney notified me that we have to file the application ASAP because there is a 8/1 deadline for current priority dates.
I didn't really understood the meaning of this and couldn't get much details from attorney as I have no direct contact with them (my employer is the one who directly contacting him)
As per my understanding, I think he is talking about the new visa bulletin posted for August 2016. As per the August bulletin It seems like the priority dates for EB2 category for "Rest of the world" is backed till 2014 (this is as per the "Final Action date" chart) But as per the "Date for filing" chart it has mentioned as "Current" for EB2 category.
I'm not very clear about these terms but I know that something is not right. Attorney told me that they are going to file my application before 8/1.
My questions are:
1) If they file it before 8/1, Am I safe? (Since July visa bulletin has "Current" for EB2) can I still go with current priority date.
2) When they say file before 8/1, does that mean we have to file application before 8/1 or USCIS should received it before 8/1?
3) Is there any risk associate with this if we filing at the last minute?
4) In case if they unable to file it before 8/1, what are the options I have? Seems like the EB3 category has "current" priority dates for August. Is that OK to switch to EB3 and file it?
