Marrying just prior to expiration of B1/B2 stay limit

  • Marrying just prior to expiration of B1/B2 stay limit

    Hi
    Marriage is to take place soon prior to expiration of B1/B2 visa limit (August 24). Want to avoid falling out of status. Once married, will that be ok? It may take a couple of weeks to get the marriage certificate, so unless the wedding takes place by the first week in August, we may not have the certificate of marriage to add to forms 130 and 485 to send. So, if marriage takes place Aug 20, to pick a date, and wait till Sept 1 to mail the complete package with the certificate, what happens? out of stay, or safe bc you are already legally married? Alternatively, could I submit the forms without the marriage certificate? I'm apprehensive of sending incomplete materials. What is your advise please? anyone on this situation who can share experience? Are you legal to stay if you have married but not yet submitted the forms to the government (bc you are missing the certificate) and your legal time to stay expires?

    Warning, do not send incomplete documents or you will recieve an RFE-"Returned for Evidence"

      I agree. Do not, under any circumstances, submit incomplete documentation or your case may be denied. Rather get all your documents together before you submit.

        it does not really matter when you get married, just make sure you can prove your marriage is real,pics, bonafide evidence..sometimes they may come to your house to see if you are a real couple. good luck
