  • Canadian to the US

I brought my wife (we have been married 5 years and living in Canada) to Las Vegas to live and was intending to return to Canada. We found it very hard to separate and began proceedings from here.

I did not receive an I-94 pass when I entered (Canadian are not required and I showed the border guard my birth certificate and my driver's license) and he waved us in at Detroit.

My wife filed an I-130 and received a notice that they had got it. I think I got things mixed up by filing an I-765 (we tried to do the work ourselves) but now they want an I-94 paper.

What can we do to correct things and put it back in order?

Alright, well coming from a Canadian I understand what your saying. I am currently filing for Perment Residency under my Step-Father (U.S. Citzen). The I-94's are NOT required for perment Residency (If your a Canadian),Canadians are allowed to stay in the U.S. as long as 6 months. The Uscis forms ask for it but if you provide your Canadian Birth Cereficate and other Canadian ID (with your photo and information like a Canadian Health Card) then you will alright. All you have to do where it says "I-94 ID number..etc" just put down N/A and they will understand that your Canadian. Also, it says to give proof of evidence that your legal and that you crossed the border legally, well Immirgation officers advice to give proof of you crossing the border with your name and a date you crossed like a Credit Card receit (Toll Fee acrossing the border) or even a Receit from the Duty Free shop, but most likely the Immirgation office will not request other evidence, and if so then they will call you in for questoning on when and how you crossed the U.S. border.

    Good luck
