  • Approved I-130 but never applied for my visa

    Hi,
my husband filed an I- 130 for me and it was approved 4 years ago but since I am subject to a ten year bar (overstayed my visa) and my son had a devastating accident, we decided to stay in my home country (Germany) his visa here expired and he now returned to the US. I am still in Germany and we are trying to find out how to go about filing for my paperwork. Everything I find online just tells me the way it goes after your i-130 was approved but since we did not pursue my visa back then this info is not helping me at all. Does anybdy know how to proceed in my case?

    Thank you

    hi,
I once sent a I-130 (about 4 years ago I think, or more), got it approved and just received a letter in the mail last week saying they consider my application abandoned since I haven't pursued it and that my visa is no longer available; so, in other words, you may have a clean slate from that perspective; the 10 year bar... there is a way to ask for that bar to be waived, check the USCIS website
