  • Process - Adjustment of status

    Hi All,

Thank you for your time. I am a US citizen from India. My parents are in USA on visitor Visa and, I would like to file Adjustment of Status. Can someone provide the whole process? Are there any forms required other than I-485? Is Medical required?

    Thanks again.

You must submit two fees, $420 and $1,070 for each, along with immigrant medical exam in sealed envelope, forms I-130, I-485, I-864, I765 and I-133, with supporting documents.

Immigration to the US is a 2 step process that can be accomplished either in the "Home Country" or here in the United States. If the process begins at the Home Country its called "Consular"process at the nearest US Embassy or directly here in the US.
AOS is a 2 step process because the US Citizen must establish proof that the person they are sponsoring is immediate family/relative. This is accomplished with the Petition for Alien/Relative aka I-130

For citizen or lawful permanent resident of the United States to establish the relationship to certain alien relatives who wish to immigrate to the United States.
Note: A separate form must be filed for each eligible relative. USCIS processes Form I-130, Petition for Alien Relative, as a visa number becomes available. Filing and approval of an I-130 is only the first step in helping a relative immigrate to the United States. Eligible family members must wait until there is a visa number available before they can apply for an immigrant visa or adjustment of status to a lawful permanent resident.
The I-130 as RayB quoted is $420 and takes appx. 5 months to process. If approved then you can begin the actual "Adjustment of Status" or commonly referred to as AOS for each individual.
Again RayB is correct in quoting $1020 for each individual not including a medical exam from an approved USCIS Civil Surgeon. The I-485 is the application required for the AOS.
Both procedures can be succesfully completed with out an attorney but you must have all documents required by USCIS.
If we can give more help don't hesitate to post.
