  • AOS package - Is this processing time normal?

    Hi, really need some advice as I'm a little confused as to the timeline, I think it's taking a little too long. What do you think? What should I do?

    This is my case:

    I-130 - Filed as category F2A -Spouse of Permanent Resident
    PD: 08 APR 2015

    March 2016 - My spouse becomes US Citizen

    03/19/2016 - AOS package received by USCIS - NBC Lee's Summit MO - Including request to update category to IR, I-485, I-131, I-765
    04/15/2016 - Biometrics taken
    05/23/2016 - I-131 Approved
    05/26/2016 - Combo Card received

    No RFEs, everything smooth.

    However, as of today my I-485 status still shows "On March 19, 2016, we accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number MSC YYYY YYYY X. Our National Benefits Center location is working on your case. We mailed you a notice describing how we will process your case. Please follow the instructions in the notice"

    Is this normal? If not, what should I do to verify if everything is ok? So far the customer service (CSC) has not been useful when I asked to double check if the category was "upgraded" correctly or get any update on the status.

    There seems to be no "normal" with USCIS!
    On a approved I-130 and a I-485 AOS times vary with Consular or if you reside in the US.
    If you reside here avg process times are 87 days, as you are first in line so to speak for a visa number.

      Thanks Adrian, yes I reside here in the US, that's why I'm wondering...this seems to be taking wayyy to long, it's 5 months and the i485 is still in progress.

        Your initial filing was an F-2? "Family Second Preference?

          Yes the I-130 was filed as second preference because that was the status in Apr 2015.

          After my spouse became citizen, I asked to update the category to IR and filed i-485 and all the ancillary petitions. And that was March this year. The ancillary petitions got approved and I got my combo advance parole/work authorization in May, which makes me think my category has been updated so it became current.

          However I can't understand why the i-485 is still pending after all this time...
