need help with RFIE for I-864w

    It says that USCIS cannot accept your SS statement as evidence because you DO NOT fulfill the 40 qtr. requirement. Further more USCIS is requesting that the Petitioner/Sponsor fill out the I-864 "Affadavit of Support and submit.

    ok i got me a joint sponsor, i am waiting to get those documents back today.
    now i got a couple of questions on the i-864, if you could give me some advice please.

    1. i-864 part 6 my husband gets ssdi, what should he check ?
    2. also he was on ssi ( from dec. 2015 till may 2016 )until he received his ssdi beginning in may 2016, i understand he cant use ssi but he can use ssdi right ?
    3. his income from ssdi is below poverty guidelines, does that matter if the joint sponsor has income above the poverty guidelines, i mean will i get denied because the primary sponsor has insuffient income ?
    5. since his income is insufficient, and we dont have assets, does he need to fill out part 7
    6. do i as the intending immigrant need to fill out form i-864a also ?

    sorry about all these questions, and i also read the instructions but some questions are a little confusing. i just wanna make sure it gets filled out right so we dont get another rfe.

    i appreciate any help , advice

      In Part 6 you should check "1.d.---Unemployed"
      In Part 6 right under 1.d. enter in what his expected ssdi income for 2016
      In part 7 since you have no additional assets put "N/A" where appropriate.
      And last, since you are the "Sponsored Immigarant" you cannot fill out the I-864a

        thanks adrian, thats what i thought i just wanted have it confirmed. will there be a problem with him having insufficient income as long as the joint sponsor has plenty enough income ?

                  hey adrian,
                  when i send in my response for the rfie, do i need to send in a g-1145 again or anything else ?
                  other then
                  1.the rfie letter, cover letter, Form I-864 for sponsor including tax transcripts and letter from social security office,
                  2. Form I-864 Joint Sponsor including Tax transcripts for self employment and birth certificate,
                  3. Form I-864a Joint sponsors household member with birth certificate

                    No you don't need to send a new e-notification G-1145, USCIS already has your original on file, also you don't need it if you set up an an account on USCIS and you can set yourself to receive txt/email alerts

                    1) I do'nt know whats in the RFE but a cover letter never hurts.

                    2) I'm looking over my I-864 that I sent in with my I-130 petition and if you look on Part 1 under 1.f. you must include proof of the "Sponsors" U.S. Citizenship. So the answer is YES! Include the "JOINT SPONSORS BIRTH CERTIFICATE"

                    3) I "DON'T KNOW" the answer to question 3. If it was me I would fill it out as best I could.
