  • Can I move while my marriage-based AOS is in process?

    Dear friends,

    I had a question about moving and changing my address while my marriage based AOS is in process.

    What if I have applied from and living in City A/State A. I get a consulting job offer in City B/State B. I accept the consulting offer in City B/State B and return home every weekend to spend time with my spouse in City A/State A. Will USCIS see this as a normal reality of today's world where partners though living at a common address sometimes have to travel to other locations for work?

    Or another possibility is that I get a job offer in City B/State B and both me and my spouse move to this new city. We change our address, get a new apartment/lease and notify USCIS of our change in address. Could this create complications for an impending I-485 AOS?

    Changing addresses during any immigration processing procedure can cause lots of problem.

    My advice is to continue receiving mail at State A until your AOS is completed.

      So, I am assuming you are saying that I should maintain my address in state A, but it is completely ok to work in City B/State B until the AOS process is complete?

      And this will not cause any issues during the AOS interview even though I will be traveling back and forth every weekend??

        Anything unusual is likely to cause problems during the interview. It all depends on how you present the evidence of living apart during the week, and providing proof of your continued domicile in State A.

          I agree that anything unusual may cause problems. But I have an excellent offer in State B that is offering a six-figure salary and not finding comparable offers in State A where I am living with my spouse. My Spouse intends to move to State B as soon as AOS is done. We are holding up on moving until AOS is completed.

          The evidence we have:
          - Utilities bill with both our names
          - Internet bill with both our names
          - Letter from landlord describing our marriage and that we are living together
          - Joint bank account showing current address in State A
          - Credit card statements showing current address in State A
          - Car insurance with each spouse on the other one's insurance
          - Driver's licences for both of us showing current address in State A
          - Sam's club cards opened together.
          - Cellphone statements showing calls made between each other for last 3 years
          - Dating/Wedding/Travel pictures and albums

          Will the above suffice as proof of continued domicile in State A?

          Any response and guidance will be appreciated.
