I-485 in process. Advice on next steps?
Hi everyone,
I would like to request your advice on best next steps with respect to the AOS and marriage. Details below-
1. I am the main applicant currently on H1-B visa valid through Sept 2018
2. Application for Green card is filed under EB-1 category
3. I-765 filed; EAD approved and card received
4. I-485 filed (concurrent application) - Expected approval January 2017
My would-be spouse is from India, currently studying in Canada but will move back to India in a month. She does not have an H or L visa and is unlikely to apply for one. I understand that in order for her to also receive the green card along with mine, we need to be married and file the required forms before my application is approved.
I can think of the following options -- your guidance would be most appreciated-
1. Get married asap --> file for H4 in India --> she travels to US, and files for GC from here
2. Get married asap --> file for "Following to join" from India --> she travel to US --> file for EAD
3. Get married before Jan 2017 --> file for her green card from India --> wait for approval before she can travel (1-3 years?)
Is there an option for me to "pause" my application now that the I-485 has been filed?
Any other suggestions would be most welcome.
