    Hi, got a mail from the USCIS for my wife case and I really got lost on it so hope someone have been thought this could show me how to file the right way will really help.

    This the three thing that on the letter.

    The "Sponsor's Household size" on the petitioner/sponsor's Form I-864, Affidavit of Support ( revision date 07/02/2015), was calculated incorrectly or not completed. A household size of 0 or 1 is not acceptable. Must correct and/or complete and return Page 4 of Form I-864.

    ( I think I put 1 since it only me and my wife)

    Submit all supporting tax documentation (W-2s, 1099s, Form 2555, and all supporting tax schedules) submitted to the Internal Revenue Service for the most recent tax year.

    (I send in all my W-2s for the last few years)

    Based on the documents submitted with form I-864, Affidavit of support, for the petitioner/sponsor, the income did not meet 125% of poverty guildline for the household size.

    (I make over 45k every years so wonder why they said it not meet)

    Please help us, we will really thank you from the bottom of our heart.

    Good morning sir, please understand that I am not an attorney and what I write here is from my understanding of the process as it pertains to me and my experiences.
    The I-864 seems to be challenging to some applicants and from my understanding is that you are the US Citizen and your wife is the beneficiary, and that you are filing concurrently your I-130 aka petition for alien relative and I-485 aka adjustment of status AOS?

    You are a total of 2 in your Household so use 2 on page 4 of your I-864!
    You make an income of $45,000 which is well above the poverty line, what USCIS is asking in there request for further evidence is 3 years of tax returns, W-2's alone is insufficient evidence.

      I am with Adrian as well, not an attorney but I submitted my i-485 package with no issues whatsoever. Your household size needs to be 2.

      For the tax documentation, did you send in taxes that were filed and all W-2s and 1099s for the last 3 years? You'll have to double-check what income you put on your i-864 and make sure the documentation matches the income. There can't be any type of discrepancy or they will reject it.

        Thanks for the reply. Yes I'm an US citizen and we trying to file AOS. So it have to be 3yrs atleast? Can I file the whole new I-864 then mail it in?

          Take care to read your RFE Bulletin, USCIS will tell you specifically what you need to send back to them. If they told you to send a new I-863 then yes, if they are simply asking for more documentation then no.
