  • Green card and previous UK conviction

    Hi there,

Am just about to begin my application for US green card having been married to my US wife for 2 years and residing here in US. Am a little concerned because back in 2009 in the UK I was convicted of DUI and leaving scene of accident (damaging my own car) and had to perform community service. According to UK law this is now a spent conviction and need not be disclosed.

Does anyone know if I will need to disclose this on my application?

    Thanks,
    Dominic

Good morning Dominic, I am not an attorney so I cannot guide you on the legality of your issue. How ever I reccomend truthfulness above everything else. The reason for this is if you disclose the answer on your application it will defuse the situation during your interview where its possible the USCIS officer conducting the your interview will have this information already and if you had not disclosed it and you were asked about it it may prove to be a sticky wicket so to speak.
