please someone help
just to tell my short story, we have filed I-130 , I-485 , I-864w , I-765 , I-131.
I went through Biometrics already, on aug. 11th i got a RFIE for I-485 ( Notice from Aug. 5th ) , they want the I-864 instead of the I-864w.
I racked my Brain trying to figure out why they didnt take the I-864w and what i could do about it, which took me a couple of weeks and decided to just send in the I-864 instead with a Joint sponsor, which took me a while to find.
i finally found a joint sponsor, i am waiting to get those documents back .
now i got a couple of questions on the i-864
1. I-864 part 6 my husband gets ssdi (Social security disability insurance ), what should he check ?
2. also he was on ssi ( from dec. 2015 till may 2016 )until he received his ssdi beginning in may 2016, i understand he cant use ssi but he can use ssdi right ?
3. his income from ssdi is below poverty guidelines, does that matter if the joint sponsor has income above the poverty guidelines, i mean will i get denied because the primary sponsor has insuffient income ?
5. since his income is insufficient, and we dont have assets, does he need to fill out part 7 or leave it Blank ?
6. do i as the intending immigrant/ Beneficiary need to fill out form i-864a also ?
8. how long will it take from the time they receive my response till they go to process the or all files ?
i have read the instructions so many times but some questions are a little confusing and i looked through different forums and i guess i just read to much to where it all runs together...lol. I am going by the date of the rfie notice, so i am on day 42 from 87, i hope that doesnt matter to much as long as i get it there before the deadline. i just wanna make sure it gets filled out right so we dont get another rfe and as soon as i get the documents from my joint sponsor i will send it off, hopefully in a few days
