  • Request for Initial Evidence! Need Information?

    Hello Friends,
    I have applied for the change of status I-485 in August. Today, I got the Request for Initial Evidence (I-485) from USCIS.
    I have also applied for the Work Permit and Advance Parole. I want to know that Request for Initial Evidence regarding change of status application will affect the processing time of the Work Permit and Advance Parole?
    Will it affect processing timelines?

    Will it affect processing timelines? Short answer is YES!
    The RFE halts any processing of your application until you respond back and satisfy USCIS.

      What about Work Permit and Advance Parole? Will it also affect both applications?

        Your RFE will affect the processing time on your green card BUT it will NOT affect the processing time on your working permit. I know this because I am in your situation as well and have spoken to a USCIS field office about this.

            I am in the same situation however as of what I know and my lawyer told me, it does affect the EAD card. EAD timeline is 90 days. if you got ref like me on day 50 then your clock is back to day 0 and starts again when USCIS gets the requested evidence. Unfortunately this is how it is.
