  • A question!

    Hi there,

I got married to a US citizen 2 months ago. I filed my I-485 papers 1 month ago. I got my receipt and the biometric appointment. I am on F-1 visa. My school contacted me and told me that if I don't want to continue in my program, they will terminate my visa and go home. My question is, are they have the right to terminate my visa and I am in the process to adjust my status? I am not willing to go back to school.

    Thank you.

If your I-130 and I-485 are in process mode, based on marriage to a U.S. citizen, you are "protected" from adverse action even if your student visa is cancelled.

Thank you Ray. My receipt number always gives an error when I'm trying to check on my status online. Does that affect anything? Or I'm protected from the day that they received my papers?

The error code for an unrecognized receipt number is fairly common and quite common with numbers not put in the database for the status message.

That is depend on your school attendence policy too

hi,I m on F1 too and got married in march end this year and applied AOS 485 in first week of April, and my school did not even know anything until this month 15 sep when I told that I dont need to renew my I-20 for further study bcoz I already have GC interview scheduled for this month end and they were like ok no problem we will terminate your F1.But all these month from April to sep my school did not even know about it neither they told me anything until I let them know.
But yes, they can tell you about termination when your school has a strict attendence policy and have to attend school certain hours/ week and You are not being punctual for those attendence ,that case they will tell you that they will terminate,in some school they dont even let you know if u dont shpw up for while enough and they just report USCIS about you are no more their student.but if you attending achool for a purpose and have course left to study and complete ,school can not terminate your F1 just bcoz you filed 485.
