    Hi Everyone,

    My wife is an American citizen and we live in Brazil. We are planning to move to the US. However, I only have B1/B2 visa and we don't want to apply for immigrant visa through Brazil (American embassy), because it takes to much time. We don't want to wait too much, and also it's a more expensive path.

    Is it possible to apply for adjustment of status (green card + ead + advance parole) after entering with B1/B2 visa? I've heard that there's a risk, as the immigration department may interpret my situation as a fraud. Do you guys have any experience on this kind of situation?

    Any other alternative? For instance, apply for a F1 (and enroll in a course) then apply to adjustment of status after entering with F1? Or any other idea?

      When your wife enters the U.S. on her B2 visa, any expression of intent to remain in the U.S. may result in a bar from visitor visa entrance.

      Once in the U.S., however, after waiting a reasonable period of time (30-60 days), you can submit an I-130 and I-485 at same time and remain in the U.S.

        Hi Bruno, I am from Brazil as well! yes, you can apply after entering on a B2 visa. The biggest problem you will face is passing immigration when you first come. They will ask you why you are coming and you can't say you are coming to stay. You shouldn't lie as well. Just say you are coming to visit your wife's family and you will be fine. I had to go through the same process so if you need help let me know. Good luck to you
