    Hello all,

    Here's my situation:

    I am a U.S. citizen sponsoring my husband who is currently in the U.S. as an F-1 student, applying for AOS (I-130, I-485, etc.)

    I am the petitioner so I filled out the I-864 Affidavit of Support form. For my current annual income, I do make enough mone (a little more than the Poverty Guideline this year only). However, my past 3 years have been wayyy lower than this and the position I currently hold is only temporary, therefore unstable. Besides, I only got this job recently this year so my employer could not issue any income verification letter, since I am only part time and temporary (my schedule/hours are irregular too).

    So, I decided to add my mother as a joint sponsor (she makes way more than poverty guidelines and has stable income, easy to prove). However, then I found this on immihelp:

    "If a petitioner or sponsor meets the minimum income requirements, there can not be a joint sponsor, unless the consular officer or the DHS immigration officer specifically requires it"

    As I said, my estimated current annual income for this year DOES meet the requirements technically, but my past 3 years did not, and I cannot prove my current income because it is a new temporary position, which I probably won't even have next year.

    Given the instability of my situation, will the USCIS accept that I add my mother as a joint-sponsor, even though I technically make enough money this year? I'm afraid that, since my I-864 current income is technically enough, they won't take my mother as a joint sponsor, and will send me an RFE to prove my current income, which I can't!

    I would follow the directions... You need to have your previous W-2s and at least your most recent check stubs because that should be proof enough without your employer verifying. Have you mother as back up just in case. If they want extra proof they will give you time to submit it without you having to start over. The point is that you meet/exceed the requirements at the moment. Good luck!

      The thing is that I have my previous W-2s, but they do not reflect my current situation, they only show $8,000 that I made last year in 2015, versus this year I make $25,000. I will definitely use my mother as a back up, but I'm hoping they won't ask me for more info, because again, my current job will not issue any document verifying my income because it is a temporary part-time position, so it is unstable. And I've read in the past that, if your current income is much higher than previous years (which it is for me), then they might ask for more than just pay stubs, like employer letters, etc. Maybe should I put a note and explain that my employer cannot issue income verification letter due to the instability of my position?

        Do you have an offer letter from the employer? Outlining your pay and the type of job it is?

          No, this is just a temporary positions, and I do a few hours here and a few hours there, my schedule is very irregular... Also, I only started this job 5 months ago. Therefore my employer cannot issue any letter outlining my pay since it is temporary and my paychecks vary a lot. However I do have my most recent pay stubs, showing "year-to-date" for the income I have already earned so far for 2016... Would that be enough? I asked my employer and they won't do any letters for me

            Only thing I can say is try... You will either get approved or asked for addtl. info. I probably would go ahead and name your mother as joint sponsor

              That makes sense... Otherwise, should I put a note explaining that my income is unstable and only temporary? I just want them to look at my mom's I-864 because she makes enough money, we attached her past 3 years of tax, and recent pay stubs for 6 months... My goal is that they use HER as a joint sponsor and that they do not count me in since my income is unstable. You know what I'm saying? Instead of them sending me an RFE to ask for income verification letters, which I can't have, I'm trying to have them simply use my mom as a joint sponsor (we already prepared her documents). What can I do? Should I explain my situation on the cover letter or something?

                I would have it available. It makes sense to over do it instead of not having enough info
