  • I-485, interview completed officer thinks my previous marriage was fraudulent

Hi, let me start from the beginning, I got married in 2007, received my green card back then through my ex-wife(US CITIZEN) with no problems at first interview and/or when I applied to remove conditions on my green card, then I got divorced in 2012, got back into a new relationship at the end of 2012, I became a US citizen this year(Jan) and got married again with my current spouse in FEB, we just had a baby in Jul, I applied to adjust status on her on march and we had our interview yesterday, this officer asked a million questions, at the end of the interview she said "I have no doubt that this marriage is in good faith but I think that your fist marriage was just to get your green card and you know why; is my personal opinion, good bye" then my wife asked the question, does this doubt interfere in this case?? and the officer replied "yes and no"

What should I expect now, can they go back and investigate my first marriage again??? can they denied my wife's application?? can the revoke my citizenship???

What Did the Officer Ask ?

What did the officer ask ?

What part of the interview made her feel like the previous marriage was fraudulent ?

Did the officer ask questions about the previous marriage, or just about the current marriage ?

Do you have a lawyer ?

It seems, just from reading his post, that he married a US citizen for long enough to get his green card. Divorced in 5 years, after he is eligible for Naturalization... (Which for marriage based is 3 years). Now he is married to someone who is attempting to become a US Citizen herself... and he is able to sponsor her because he is a US citizen now...

          Don't Marriages End ?

          Hi all,

Just chiming in here, and maybe in defense of the original poster :

Don't marriages end ? He got married for five years ... then got divorced. In 2016 America, this is (unfortunately) very much a social trend. Now, it could be that he got married and then divorced for the citizenship. Or maybe not. People get married and divorced ALL THE TIME. Why is it so suspicious that got divorced after 5 years ? Unless there is more information, I think this suspicion is just prejudice against immigrants and the intrusion into people's lives which USCIS subjects AOS applicants to.

Right... It does happen all the time... But when you have been around immigrants and know the trend... It happens a lot unfortunately... People find a USC who is willing to marry them. They live separately for most of the "marriage" (some times living together, but living separate lives) and it lasts long enough for the process to be completed. Then the newly naturalized citizen is free to bring his actual wife/fiance over and sponsor them to become citizens as well... It sounds far fetched... But you would be surprised how often this actually does happen

And just so you know... I feel like the whole process is unnecessary anyway. USA is an immigrant country. The majority of citizens come from families who migrated. I feel like they should only worry about potential terrorists. Anyone who would like to come here to make a better life for themselves and their families should always be welcomed! So I understand the caution because of past problems... but once someone passes the background check that should be enough....
