I-130 Birth Certificate Needed if petitioner was born abroad?

  • I-130 Birth Certificate Needed if petitioner was born abroad?

    Hello, pretty simple question:

    My husband is filling the I-130 to petition me. He is a U.S. citizen but he was born in the Philippines. He obtained U.S. citizenship through his mother when she became a naturalized U.S. citizen, and my husband was 16 years old at the time (so he does not have a naturalization certificate in his own name). He has a U.S. passport.

    In this case, for the I-130, does he have to attach his birth certificate from the Philippines, or is that unnecessary? My initial understanding was that the birth certificate could be used on the I-130 to prove U.S. citizenship; but in his case, he was born abroad so we only attached his U.S. passport. Is only his U.S. passport enough? Would his foreign birth certificate be required? He doesn't know where it is, that's why I'm asking in the hope that we will not need to attach it to the I-130.

    The birth certificate is not an absolute requirement if the petitioner has a U.S. passport, but a birth cert copy might still be requested by USCIS. He can order a Philippine passport online from:

      Why would he order a Philippine passport? He is now a U.S. citizen and is not a citizen of the Philippines anymore. All I was asking is if his filipino birth certificate was required? We attached the copy of his U.S. passport to the I-130 but not his filipino birth certificate

        Sorry, I meant to say that he can order a birth certificate from that website if he was born in the Philippines.
