i485 request for initial evidence...PLEASE HELP!!

  • i485 request for initial evidence...PLEASE HELP!!

    hi everyone!!

    sent package to uscis i130, i485, i864 etc etc... few weeks later received Request for initial evidence.

    1- submit all suporting tax documentation ..... for recent tax year (before i sent petitioner's photocopy of w-2 for 2015) do they need more evidence for how much my wife earned???
    2- based on submited i864 petitioner did not meet 125% income..... submit evidence of assets or get joint sponsor
    my wife usc had 20000$ for 2015. family of 5(3 kids) need about 35k so... 35-20=15 usc spouse multipy 3... 15X3=45000$
    I(imigrant she's sponsoring) own house(no mortgage, no bank) worth about 280000$ ,
    before we sent copy of deed, appraised house report (licensed apraiser) 280000$, we also sent copy(titles and apraisals) for 4 automobiles
    about 16000$ .
    total assets about 300k $

    so.... what are we suppose to send more???

    Hi Janosik81, let me understand what you have here; is the house in your name only? If so, they would not accept it as you can not sponsor yourself based on the family visa you're petitioning for. Since her income is below the income stipulation, you need to get another sponsor. I think you could have changed the property's ownership to both your names before filing, maybe that would have sufficed. Anyway you have no problem, just get a joint sponsor - which is easy to get if you are a person of good behavior - then have the person fill a new 1-864, send it to them with all the back-up documents, and your case will be updated.

      The RFE might be in regards to Part 6 Sections 19a.a. 19.b. and 19.c. it asks for 3 years worth of adjuste gross income on IRS 1040ez.

        Yes home is in my name only... i think you're right need look for another sponsor

            i wonder why i864 application has fields "sponsored immigrant assets" if they do not really accept it??

                  instruction for i864 says that it regards on where immigrant reside.
                  for me it's mean if immigrant reside in US it's easier to cash assets in 1 year

                  insrtuctions says something about hardship i financial loss for owner...

                  anyway.. what confuse me that when they sent me RFE they didnt explain exactly what problem is with my assets...

                    called lawyer and looks like because my visa expired, uscis take nothing from me. even proof that funds are located in other country. NADA.
                    just need other sponsor... thanks everyone for help

                      i got joint sponsor.. BUT.. he filled income return tax with his wife.. what i found that his wife need also sign i864a even if we dont need her income.. anybody knows anything about it??
