  • Same Sex Marriage (Gay Marriage)

    Hi, I would like to ask if the requirements are the same for Same Sex Marriage.
    Also, my spouse was married to a woman before and got divorced this April 2016. All his W2 forms has the name of his ex-wife because they filed it together. Is it fine to submit it?

    We met July of last year while I'm on a J-1 Visa. (no 2 year home residency)
    They are already separated that time and I even met his ex-wife and we became friends. (At first I thought it's not gonna be a good idea but I was wrong. It's fine with her and noo hard feelings.)
    And just this July 2016 we got married, didn't file AoS right after due to financial issues.
    But we are now doing the paperworks before this year ends.

    Hey, my husband and I filed after we got married (SSMarriage) in July. We actually sent our application in September. So far everything went well (no RFE yet and Biometrics were done in October). We are waiting to hear from USCIS about the EAD and a potential interview. It's just a long waiting game. I don't think same-sex or opposite-sex marriages are treated differently.

        Not yet, but I hope to hear from USCIS soon. None of my cases (485, 765, and 130) have changed since Oct 7 on the website. The last thing I did was the biometrics which was on 10/24. I am hoping to hear something in December.

          Everything is the same. Married my same-sex spouse 4/2015 and applied for AoS 3/2016. We were approved right away at our interview in 10/2016. Received physical card 11/2016.

            Your marriage is treated as any other Marriage. I Married my husband on March 2016, filed on April 25 2016, and on July 19 had our interview and were approved on the spot.

              Thank you for all the nice feedback. I'll be having my Medical on Monday so we can send all the papers before 2016 ends.

                Hi I am on the same case same sex marriage, however I recieved RFE for i864 - re: W2 and taxes of my husband (late tax filer) US Citizen. We paid his tax and send the w2 and tax papers again to the lawyer. So far here is my timeline.

                PD - 09/09/2016
                Biometrics - 10/12/2016
                RFE - 10/10/25/2016
                - 12/15/2016 (Response To USCIS' request For Evidence Was Recieved)
                Our National Benefits Center office will begin working on your case again

                EAD - No update same status online it says case recieved Sept.

                Can you please share how did your interview go? What are the questions asked if you don't mind.

                    EAD card mailed on 12/28/2016
                    We depend from the Oklahoma City field office and we expect to wait for several months before we can get an interview...
