    i got married dis january, my visa was k9 and im from philippines. im married to a us citizen. we had our interview last may dis year. they didnt tell us if we are approve or not, its dec already still no update. i have work already and relatives here, my problem is hes bringing a girlfriend inside the apartment and cheating in front of me, i will file a divorce but im still waiting for my greencard. i dont know what to do if i will just wait for the green card first or divorce and self petition. i dont want it to be complicated. i dont care about him anymore, i just want to fix my papers right now. is it true that theyre going to the house and check if u are together? how long did u wait for your green card? is anyone here that their greencard cones out after a year?

    Have you made a telephone inquiry to the USCIS National Customer Service Center?

    If your green card is approved, you will need professional assistance with your Removal of Conditions application two years later

      Inadmissible,

      It is not critical that the original poster pays for professional assistance to apply for her Green Card. It may make her task easier, and she does need to be aware of hos USCIS handles her type of marital situation.

      My advice would be that she not be the one to initiate the divorce, wait for the husband to do it. Also, she should remain with him for at least a year, unless her safety is threatened, before separating from him.

        I should have been clear that she need not pay for such assistance, but should seek it from a community organization that helps with immigration matters.

        In a more recent thread http://www.immihelp.com/forum/showth...-about-my-visa (which in hindsight I should have responded to instead of here) she describes her husband as already having left her household and uncooperative. If their marriage remains in such limbo in two years time, I fear a Removal of Conditions filing will be no slam dunk. If they can not file the petition and attend interviews jointly, and she can't avail herself of the divorce exception, she would have to avail herself of the hardship exception. That would require guidance and preparation.

        If I seem overly cautious, it is because of the consequences of failing to remove the conditions.

          You are right, in that the original poster's current situation is good reason for her to seek assistance in getting past the USCIS approval wall. My advice would start with her gathering all proof of living together and sharing financial affairs, for as long a period as such evidence is available to her. Secondly, she can probably wait for the 3-month countdown till expiration of her 2-year Conditional Status. She will then have to seek a waiver from joint filing for hardship reasons. But by waiting, she allows herself enough time to gather as much evidence as possible, or even a possible re-igniting of the relationship.
