  • Just Married, what forms to submit

    Hi, Im recently married in October to a US citizen. Currently am on a B1 visa and looking to file adjustment of status for permanent residency due to marriage.

    I know you can file together the I-485 and I-30 forms together. I also know there is a bunch of other forms to submit as well including:

    G-325A x2
    G-1145 to be submitted as first document
    I-765
    I-864
    I-131
    Immigrant medical exam report on form I-693 in a sealed envelope

    My Question is do you have to submit all the forms together initially or can you submit some of the forms initially and the others later.

    Also I noticed when filling out my forms that my I-94 says expiry on 9/30/16, while passport says 12/30/16 and was what I was lead to believe I had till December. will this be a problem ?

    I know you also have to submit these other documents am I missing anything:
    Passport photo of husband and wife
    Marriage certificate - does it have to be original
    copies of husband and wife's passports.

    My second question is how much does it cost to submit these forms ?, do I need seperate cheques for all the charges ?

    Thirdly is at alright to stay in the US even thought my visa expires on 30/12/16, will I get confirmation from USCIS that I can stay until my case is assessed.

    Fourthly do I need to submit a cover letter for my green card application ?, is there a pre-made cover letter that I can use ?

    Fifthly I don't not have available a copy of my birth certificate, is it alright if I submit copies of my wife's and my own passport.

    You should carefully read the instructions for the forms which are on the USCIS website. As far as the B2 visitor visa. I know you can get in trouble for being in the U.S with a B2 visa and then try to adjust. It is a low probability but nevertheless it is possible that you could be asked about it by USCIS.

      My visa has been expired since 2007,

      My parents brought me here since I was 9, left after overstaying (over 180 days), and was brought back age 11 in 2003, still with the same B2 and successfully entered the country inspected. I have lived in the U.S without status since 2003 after my last entry. I recently married a U.S citizen and I am looking to do AOS with my spouse petitioning for me. Because I entered the country legally, I can adjust while in the U.S.

      I recently remembered of this episode in my very unfortunate past and I am not sure if I have triggered a permanent ban.

      That is my main question

        You probably shouldn't have hijacked the OP's thread.

        But to answer your question, you should have no problems adjusting status. If by "permanent ban" you mean the 9C ban, no, you do not have that as you never entered illegally.
