    Hello all!

    My husband Tim (from Belgium) got married on September 15, 2016 and filed forms I-130/I-485 (and other relevant forms/documents) on October 17, 2016. Tim has his biometrics appointment on November 25. We filed everything ourselves without a lawyer, and we think we did a pretty good job! We received a request for initial evidence on November 23 for two reasons:

    #1: The petitioner/sponsor's household member on Form I-864 or Form I-864A must submit a complete Federal income tax return submitted to the IRS for the most recent tax year.

    -A little worried about this one. I (the petitioner), and my mother (the household member), both submitted IRS account transcripts for the most recent tax year. We also submitted our W-2s for the most recent tax year. I thought these transcripts were sufficient, but I guess not. We both DID file a tax return last year (2015), so no worries there. Were the IRS account transcripts not enough? Should we send our copies of the tax filings from Jackson Hewitt/ Turbo Tax? Is it really as simple as that?



    #2: Evidence of your lawful admission or parole into the United States. Such evidence includes, but is not limited to, form I-94, Arrival/Departure Record, Form I-512 with completed arrival stamp, or a copy of the nonimmigrant visa page of your passport showing admission to the United States.

    -I think this one is easy. Tim and I flew into the US together on August 12, 2016. We will make copies of the stamp that shows he was admitted into Boston, and I will also include the original flight tickets (Amsterdam-Toronto, Toronto-Boston)

    Thank you in advance for your help!!! Tim and I are patient for the green card...but we cannot wait for the EAD anymore. This request for evidence puts everything on hold, so we will try to fix it ASAP!

    You seem like you have the answer to everything except #1... They asked for the returns... Not transcripts or W-2s...
    Just my opinion... Use at your own risk...

      i hope you managed to solve your problem - and perhaps you can help me? or someone else here can? your post is very identical to my problem!

      we also just received a request for initial evidence, very similar to yours:

      1: The petitioner/sponsor's household member on Form I-864 or Form I-864A must submit a complete Federal income tax return submitted to the IRS for the most recent tax year.

      the petitioner is my husband, but he lived by himself, so no household member here - we submitted all tax information with the rest of the documents but still they ask also for:

      Submit all supporting tax documentation (W-2s, 1099s, form 2555 and all supporting tax schedules) submitted to the internal revenue service for the most recent tax year.

      now we are beyond confused - what are w-2s? my husband has only ever dealt with W-2 and online we couldn't find anything.Are we reading the letter wrong and the s refers to multiple forms?
      form 1099 and form 2555 - he´s never used it. how does he justify that to the uscis?


      regarding the other point in your letter, which also showed up in mine:

      was the passport and the original plane tickets that you mentioned enough?

        1) The total income (line 22) on the IRS form 1040 is used to determine the qualifying income for a sponsor. So yes, the tax transcripts are NOT sufficient and you would have to submit your and your mother's federal income tax return for the recent tax year.

        2) Aside from the things you've mentioned, make sure to include a copy of your form I-94.
