  • Should I wait for NVC response?-Adj of Status based on family petition

    Hello there, would like to address this to people who have done adjustment of status based on family petition (mine is F2B). I have received a Welcome letter from NVC about my family petition. I am in US and would like to pursue adjustment of status with USCIS. I understand that I need to contact or email NVC before I file for adj of status with USCIS. In fact, I already did last week. My question is, do I have to WAIT for NVC's RESPONSE to my email (informing them abt my intention) BEFORE I submit or file my adj of status with USCIS? Will NVC actually reply and what would it be saying that will be necessary for me to include in my application for adjustment of status with USCIS? Or, is informing them enough (as stated, I have called and emailed) and I can already proceed with submitting my application to USCIS?

    I'm askjng because I'm ready to mail my application with USCIS already today (all forms and supporting documents) but I am not sure if I should wait for NVC's reply to my email before I can actually do so. I cannot seem to get consistent answers from NVC agents (4 agents). Some say I wait and expect an answer from USCIS (! not NVC). Some say an email informing them is enough. Would appreciate hearing about your experiences. Thank you.

    You don't need to inform NVC. Just file I-485 with USCIS whenever your priority date is able to file for AOS.

      Appreciate your reply newacct! While my priority date is not yet current (based on Table A of the Nov Visa Bulletin), it is already qualified to file for AOS (based on Table B of the Nov Visa Bulletin and USCIS info: https://www.uscis.gov/visabulletininfo).
