  • Should I stay or leave the country?

    Hey guys!

    I sent my application (marriage based) on Nov 17 and they received in Chicago on Nov 21. But I did not get any text/email from USCIS telling me what is my case number yet. My issue is: I came here on my Tourist visa and I can stay here legally until Dec 8 (6 months). I'm afraid they don't answer my application before that and if so, should I leave the country if I don't hear back from them until Dec 8? Or I'll be ok, since I've applied already (or sent my application) in Nov? I don't want to overstay here and cause future problems.

    Also, anyone know the timeline here in Cleveland- Ohio?

    According to this forum..

    I've read a lot in this forum and everytime someone ask this same question, everybody answer DO NOT LEAVE. The thing is you already sent your documents and if you leave it is like you are giving your application up.
    These days the times for getting answers from uscis are longer than 6 months ago, I never got text/call about my case but I got the first NOA on my mail 20 days after they received the docs. Be patient and

      Hey Lmz,

      I've been reading this forum for awhile and I know about "giving my application up", but I was worried to overstay and later they argue that I stayed out of status. That's why I decided to ask here. I will follow your advice and stay.

        It doesn't matter if you are out of status while the application is pending. And if you are married to a US citizen, it doesn't even matter if you are out of status before filing the application.

        This is my personal opinion and is not to be construed as legal advice.

          Yes you should definetly stay!! Plus if you leave it means you've spent money for nothing and will have to start from 0 again...
